Abstract

Tunisia is rightly considered one of the most progressive Arab countries. After marching out from colonial period, a personal law was implemented on 3rd. August 1956. Since the promulgation of this law, Tunisia expedites its journey to modernism. The article 18 of this law prohibits polygamy and offenders may be subject to a prison sentence of one year and a fine of two hundred and forty thousand franc. Under the code 30 and 31 of this law, oral pronouncement of Talaq is prohibited. Only court can grant a divorce on the basis of: (a) mutual consent of both parties(b) the request of one party without specific grounds(c) abuse or injury. Moreover, in 2017, the Muslim woman was allowed to marry a non-Muslim. Recently, on 10 March 2018 Hundreds of women took to the streets in the Tunisian capital to demand equal inheritance rights as men. In this progressive country, these and many other laws keep a clear contradiction to Quran and Sunnah.
