Abstract

Fatwa is the easiest tool to explore the religious status of  any newer problem faced by the public, though it a s i non-binding theory by its nature still people rely on that  and get it from any renowned scholar for the sake of  awareness and to support their religious background.  The ultimate fo tlus er a fatwa depends on the  methodology adopted in it. The methodologies of  Tashd┘d and Tas┐hul the precautionary methodology  have also been practised in the earlier stages of Islam when the issues were not too complicated. But in the era,  we live in, the issues are much more complicated. So,  there is a dire need to adopt this methodology carefully.  This study throws light on the concept of such  methodology, on its reasons and principles.It concludes that the precautionary methodology of fatwa is based on  shariah rules and is admissible by its nature. However, it  may only be adopted when a jurist can not reach an  undoubted ruling or the practical shape of the issue  seems unclear or the consequences of the ruling of  permission will lead to any harm. Otherwise, this  methodology will not be applied.
