To insert conditions in nikah has been a tradition in muslim societies This article explores the validity of
such conditions.According to hanbali school of thought,such conditions must be fulfilled by husband
while all other three schools of thought do not enforce the husband to fulfill such conditions. Some
prominent contemporary muslim jurists such as Mustafa zarqa,sayyed sabiq and wahba zuhaily has
advocated hanbali viewpoint arguing that it may prove a safeguard against the exploitation of women
rights. The writer of this article has concludedthat this viewpoint should only be adopted in special
circumstances such as in societies where muslims are living in minority.
