نئے مندر کی تعمیر اور دستورِپاکستان میں مذہبی مساوات کا قانون؟
Abstract
آیاتِ کریمہ، احادیثِ نبویہ، آثارِ صحابہ اور تیرہ صدیوں کے اجماعِ اُمت اور دور حاضر کے دینی اداروں کے فتاویٰ کی رو سے بلادِ اسلامیہ میں نئی کفریہ عبادت گاہوں کی تعمیر ناجائز ہے۔ دوسری طرف جدید وطنی ریاست اور مروّجہ مغربی نظریۂ سیاست میں اس امر کی نہ صرف اجازت بلکہ مذہبی مساوات کی پوی یقین دہانی پائی جاتی ہے۔ دیگر ممالک کی طرح پاکستانی دستور میں بھی آرٹیکل 20اس امر کی غیرمسلموں کو پوری ضمانت دیتا ہے کہ مذہب کی بناپر ان سے کوئی امتیاز نہیں برتا جائے گا۔ پاکستانی قانون میں اس صورتحال کا مناسب حل کیا ہے اور ملکی قوانین اور عدالتی فیصلوں میں اس کے کیا نظائر پائے جاتے ہیں؟ ذیل میں اس پر قانونی تفصیلات پیش کی گئی ہیں۔
