قرآن و سنت میں قانون وراثت اور بحقی کی اہمیت اور پاکستانی عدالتوں کے فیصلے
Abstract
اسلام نے وراثت کے اداکاروں کو متحرک رکھنے اور معاشرتی دولت کی منصفانہ تقسیم کے لیے منفرد طریقے اور نظام پیش کیے ہیں۔ اس ضمن میں قرآن کا سلطان اور سنت مطہرہ کی عملی تصویر ہمارے لیے بہترین رہنمائی فراہم کرتی ہیں۔ اسی میں یہ حقیقت عیاں ہوتی ہے کہ قرآن کا وراثتی قانون نہایت جامع اور مؤثر نظام ہے، جو تمام معاشرتی حالات میں قابل عمل ہے۔
پاکستان میں عدالتی نظام کے تحت متعدد وراثتی کیسز کے فیصلے اسلامی تعلیمات کی روشنی میں کیے گئے ہیں، جن کا مقصد نہ صرف انصاف کے تقاضوں کو پورا کرنا بلکہ قرآن و سنت کی روشنی میں وراثتی معاملات کو شریعت کے اصولوں کے مطابق حل کرنا تھا۔
اس مضمون میں ان عدالتی فیصلوں کا تفصیلی جائزہ پیش کیا گیا ہے، جو اسلامی وراثتی قوانین کے مطابق کیے گئے اور ان کے سماجی اثرات پر روشنی ڈالی گئی ہے۔ اس کے علاوہ قرآن و سنت کی تعلیمات کو سمجھنے کے لیے اس قانون کی اہمیت اور پاکستانی عدلیہ کے کردار کا بھی جائزہ لیا گیا ہے۔
