Siasah Shariah: A Mean to Ensure Justice in the Society

Abstract

Islam is a complete, universal and permanent code for the guidance of all spheres of
human life. These characteristics of Islam require two kinds of peculiar qualities in the
rules of Islamic law to remain fit for all the times and all the circumstances. One type
is which makes the rules of Islamic law applicable universally i.e. the fundamental
textual unchangeable principles which are not subject of any more ijtihad. Second is
the type of rules which are flexible and are applied according to the demands of time
and circumstances. The flexible part of rules which are legislated for governance
purposes to keep the society affairs on the track of justice is called “siyasah
Shariyyah” by the Muslim jurists. In the current article the background of Siyasah
Shariyyah has been explained by discussing the significance of justice, its meaning
and the texts of Quran and Sunnah about justice. Paving the way towards the
discussion upon the meaning and scope of siyasah Shariyyah, the article tries to look
into this matter in the light of opinions of different Muslim jurists. The main
conclusion drawn from the discussion is that Siyasah Shariyyah is required to
complement the body of political system of Shariah.
